F4 Kidnapping Conviction Vacated

After filing a Rule 35(c) supplemental petition raising multiple theories of ineffective assistance of trial counsel, the court granted relief entirely and vacated a felony kidnapping conviction. My client was released from a substantial prison sentence on a time-served misdemeanor conviction.

Domestic Violence Conviction Reversed on Appeal

We appealed a domestic violence conviction on multiple grounds, including improper introduction of irrelevant evidence at trial. The Court of Appeals agreed with our argument, reversed the conviction, and granted a new trial. 

Sentence Reduced from 48 Years to 30 Years

My client was serving a 48-year sentence for attempted murder after losing at trial. We filed a detailed postconviction petition, demonstrating that both trial and appellate counsel were ineffective. The prosecution agreed to a negotiated resolution where my client was resentenced to 30 years on a lower charge — an 18-year reduction.

Colorado Supreme Court Reversal

After the Court of Appeals rejected our appeal, we filed for review in the Colorado Supreme Court, alleging an illegal sentence was imposed. The Colorado Supreme Court agreed that the sentence was unlawful and reversed both the Court of Appeals and the trial court's judgment.

While that case ultimately resulted in a victory for my client, it also completely changing the landscape for how district criminal courts are permitted to extract restitution from criminal defendants in Colorado.
